Terms & Conditions of Sale

2.1 About these Terms

These Terms & Conditions of Sale apply to purchases made through the Morrow Co. Remedy Essentials website. Morrow Co. Remedy Essentials is operated by Morrow Publishing House Pty Ltd ("Morrow", "we", "us" or "our"). By placing an order through our website, you confirm that you have read and agree to these Terms & Conditions of Sale.

2.2 Products and information

We take reasonable care to ensure that product descriptions, images, ingredients, pricing and other information displayed on our website are accurate. Product packaging, presentation or appearance may occasionally vary from images shown online. Information provided through our website, product packaging, guides, booklets, social media or other Morrow materials is general information and should be read together with the directions, warnings and other information supplied with the relevant product.

2.3 Homeopathic products and general information

Certain products sold by Morrow are homeopathic preparations. Morrow is a retail business and does not provide personalised medical, homeopathic or healthcare advice through the sale of its products or through general information published on its website.

Information provided by Morrow is not intended to diagnose a condition or replace individual advice from an appropriately qualified healthcare professional. Always read the label and follow the directions for use. Seek advice from a qualified homeopath or healthcare professional where appropriate. For urgent, serious or worsening health concerns, seek appropriate medical attention.

2.4 Eligibility and customer information

By submitting an order, you confirm that:

  • you are legally capable of entering into the purchase;

  • the information you provide is accurate and complete;

  • you are purchasing products for lawful personal or household use unless otherwise agreed with Morrow; and

  • you will use products in accordance with their labels, directions and applicable warnings.

2.5 Orders, availability and acceptance

All orders are subject to Morrow's acceptance and product availability. Submitting an order constitutes an offer to purchase the selected products. A contract for sale is formed when Morrow confirms acceptance of the order.

Morrow may reasonably refuse, suspend or cancel an order where:

  • a product is unavailable;

  • pricing, product or stock information contains an obvious error;

  • payment cannot be verified or completed;

  • fraudulent or unauthorised activity is reasonably suspected;

  • order quantities appear to be intended for unauthorised resale;

  • the delivery destination is not serviced by Morrow;

  • supplying the order may breach applicable law, regulatory requirements or carrier restrictions; or

  • circumstances outside Morrow's reasonable control prevent fulfilment.

Where Morrow cancels an order after receiving payment and the cancellation is not caused by the customer's breach or conduct, Morrow will refund the amount paid for the cancelled goods.

2.6 Pricing and payment

Prices are displayed in the currency indicated on the website. Australian prices include GST where applicable. Payment must be successfully processed before an order is dispatched. Payments may be processed by third-party payment providers.

2.7 International sales

Morrow ships to Australia and selected international destinations made available at checkout. Morrow does not currently accept orders for delivery to the United States of America, Canada or Mainland China.

Customers outside Australia are responsible for ensuring that products may lawfully be imported, possessed and used in their destination country. The customer is responsible for customs duties, import taxes, VAT, clearance charges, local fees or regulatory requirements unless Morrow expressly states otherwise.

Morrow does not warrant that a product available for lawful sale in Australia may lawfully be imported, possessed or used in every overseas jurisdiction. Where an order is refused, detained, seized, destroyed or returned by an overseas customs or regulatory authority for reasons outside Morrow's reasonable control, Morrow is not responsible for resulting loss, charges or delay to the extent permitted by law.

Morrow may add, remove or restrict international delivery destinations from time to time. Availability of a destination at checkout does not constitute a representation that every product is lawful for import, possession or use in that jurisdiction.

2.8 Individual results and outcomes

Individual experiences and responses to products may vary. Morrow does not guarantee that use of a product will produce a particular result or outcome. Nothing on the website, product packaging, educational materials or other Morrow communications should be understood as a guarantee that a product will prevent, cure or resolve a particular illness, condition or symptom.

2.9 Ingredients, sensitivities and individual circumstances

Customers are responsible for reviewing the ingredients, directions, warnings and other information provided with a product before use. If you know or suspect that you or the intended user may be sensitive or allergic to an ingredient, or you are unsure whether a product is appropriate due to pregnancy, breastfeeding, medication, an existing medical condition or other individual circumstances, seek advice from an appropriately qualified healthcare professional before use.

Discontinue use and seek appropriate advice if an unexpected or adverse reaction occurs. To the extent permitted by law, Morrow is not responsible for loss arising from use contrary to product information, known sensitivities or allergies not caused by a defect in the product, or failure to follow applicable directions and warnings.

2.10 Product descriptions and imagery

Product descriptions, photographs, illustrations and other website content are provided to help customers identify and understand our products. Minor differences in colour, packaging, presentation or appearance may occur. Unless expressly stated otherwise, descriptive information does not constitute a guarantee of a particular therapeutic outcome.

2.11 Product storage and use

Customers are responsible for storing and using products in accordance with the product label, packaging and accompanying materials. Morrow is not responsible for damage arising after delivery from misuse, improper handling, incorrect storage, failure to follow directions, accidental damage, alteration or use inconsistent with the intended purpose of the product, except to the extent liability cannot lawfully be excluded.

2.12 Product recalls

If a product supplied by Morrow becomes subject to a recall or safety notice, customers must follow any instructions provided by Morrow, the manufacturer, supplier or relevant regulatory authority, including immediately ceasing use where directed. Where required, Morrow may arrange replacement, refund, return or disposal of the affected product in accordance with applicable law.

2.13 Events outside our reasonable control

Morrow is not responsible for delay or failure to perform an obligation where caused by circumstances outside our reasonable control, including natural disasters, severe weather, transport or postal disruption, industrial action, supply-chain interruption, government action, border or customs restrictions, widespread telecommunications or technology failures, or other comparable events.

Where reasonably possible, Morrow will take steps to minimise the effect of the disruption and fulfil affected orders as soon as practicable. Nothing in this clause limits rights that cannot lawfully be excluded.

2.14 Australian Consumer Law

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

2.15 Intellectual property

The Morrow name, branding, product photography, written materials, guides, graphics and other website content are owned by or licensed to Morrow Publishing House Pty Ltd unless otherwise stated. They may not be reproduced or used commercially without permission.

2.16 Limitation of liability

To the maximum extent permitted by law, Morrow is not liable for loss arising from use of a product contrary to its directions or warnings, failure to seek appropriate professional or medical advice, unlawful importation or use outside Australia, incorrect information supplied by the customer, or circumstances outside Morrow's reasonable control. Nothing in this clause excludes or limits liability where it would be unlawful to do so.

2.17 General

Severability: If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as severed to the extent necessary and the remaining provisions will continue to apply.

No waiver: If Morrow does not immediately exercise or enforce a right under these Terms, that does not mean Morrow has waived that right.

Entire agreement: These Terms, together with any policies expressly incorporated into them, constitute the agreement between Morrow and the customer concerning the relevant purchase.

Changes to Terms: Morrow may update these Terms from time to time. The version applying to an order is the version available when the customer places that order.

Governing law: These Terms are governed by the laws of South Australia, Australia, subject to any rights that cannot lawfully be excluded.
